Ottavio Quirico, Associate Professor (ANUCES and UNE), has published the article ‘Towards a Peremptory Duty to Curb Greenhouse Gas Emissions?’ in the Fordham International Law Journal (2021) 44(4) 923-965.
The article considers the evolution of the obligation to curb GHG emissions as a non-derogable universal norm (jus cogens) under international law. Arguably, the practice of sovereign entities, civil society and non-governmental organisations supports the establishment of a result-oriented general duty beyond the relative effectiveness of the UNFCCC, aiming to contain global average temperature increase well below 2°C and possibly 1.5°C above pre-industrial levels, in line with the Paris Agreement.
